Record Expungement Indiana Second Chance Law

The Indiana Second Chance Law allows an individual to petition the court for expungement of criminal records or to seal certain arrests or convictions. If the petition is granted, a person’s criminal history is either expunged or sealed, depending on the reason a court granted the petition.

Expunge Indiana

Record expungement in Indiana means your criminal records are sealed and access to them is restricted. Once your records are expunged, non-governmental persons or organizations are not allowed to view the records. That means you would not have to disclose your criminal history to potential employers, landlords, educational institutions, and licensing organizations.

In Indiana, expungement does not mean the records are erased or destroyed. The courts, prosecutors, or law enforcement agencies may still be able to access your records.

Depending on the circumstances, the following may be eligible for expungement:

  • Arrests
  • Criminal charges
  • Criminal convictions
  • Delinquency adjudications
  • Trial court records
  • Appellate court records
  • Civil forfeiture records
  • Protective orders

There are different factors that are considered to expunge a record in Indiana. If you believe that you are eligible to have your arrest or record expunged, contact us today for a free consultation.

Indiana Record Sealing

The laws surrounding Indiana record expungement and sealing can be complicated, and the process for applying can be long and difficult. For most people, it’s easier to work with an Indiana criminal lawyer who has extensive experience in record sealing and expunging.

Sealing a criminal record typically prohibits anyone from accessing it without a court order. A person who was arrested, but not convicted, may file a petition to seal the records relating to the arrest one year after the date of the arrest.

In order to be eligible, the person must not have any pending criminal charges. Once a petition to seal arrest records is granted, the court files, BMV (Bureau of Motor Vehicles) records, and background check records of the state police central repository records will be sealed.

Criminal records of cases that were dismissed following a diversion agreement are among those that can be sealed. Persons charged with a first offense for possession of marijuana, underage drinking, and shoplifting are often eligible for a diversion agreement. Sealing these records can be beneficial for a person seeking employment or looking to further their education.
